Patron Use of Audio / Video Recording Technology on Casino Premises
This Policy applies to all patrons at Parkwest Bicycle Casino (“Casino” or “Parkwest”).
Any technology capable of recording video and/or audio of team members and patrons raises privacy concerns. Technological developments in recent years have produced (in addition to compact recorders and phones with recording capabilities) wearable technology capable of recording and uploading both audio and video to cloud-based systems for later retrieval and/or live streaming, typically on or through social media platforms.
Wearable technology (“WT”) poses unique challenges because it is inconspicuous and not obvious when it is in use. Some WT, such as the Meta Frame, appears almost as an ordinary, everyday accoutrement, that would not be suspected of having recording capabilities. This type of WT heightens privacy concerns.
Some Casino patrons desire to use Recording Technology (including WT) for their own promotional or educational purposes. For some, this will enhance their gaming experience. For other patrons, and Parkwest team members and business partners on premises, it may be undesirable, depending on how the technology and recordings are used.
To balance these interests, Parkwest established this Policy on Patron Use of Recording Technology (including Wearable Technology)(the “RT Policy”) to set the conditions under which this technology may be used on the Casino premises. The Parkwest default policy is that video and audio recording by patrons is prohibited on Casino premises, unless it conforms to one of the exceptions and other requirements of this policy. The publication, or posting for public viewing on any digital platform, of any video or audio recording from the Casino premises also is prohibited, except as provided in this policy.
DEFINITIONS
- Recording Technology (“RT”) – any technology capable of recording audio, video or both. This includes cell phones and Wearable Technology.
- Wearable Technology (“WT”) – any Recording Technology that is engineered or designed to be worn on a person’s body or clothing, such as a necklace, hat or glasses. WT includes devices such as Meta Frame.
- AV Recordings – any digital or analog recording of sound or light to create an audio or visual record or live/relayed transmission. This includes any audio clips and still images extracted from recordings.
- Live Streaming – recording and transmitting/delivering of audio/video data over the internet in real time, or near real time.
- Casino – The Parkwest Bicycle Casino, LLC, 888 Bicycle Casino Dr., Bell Gardens, CA 90201.
- Casino Management – The Manager of Casino Operations or the Casino Shift Manager or Assistant Shift Manager on duty.
- Social Media Influencer (“SM Influencer” or “Influencer”) – a status awarded to a Casino patron, following application and vetting, based upon criteria established by the Casino. Influencers are eligible to apply for a Location User Agreement (License) under this Policy.
POLICY
- Recording Prohibited. Audio and/or video recordings (“AV Recording”) are prohibited on the Casino premises, including gaming floor, cashier cage areas, and adjacent lobbies and hallways, unless specifically allowed under this Policy.
- Live Streaming Prohibited. Live Streaming is prohibited in all areas of the Casino, at all times.
- No Exception Areas. Certain areas of the Casino are always off-limits to AV Recording, and no exceptions will be granted. Those areas are:
- Restrooms
- Areas marked “Employees Only” “Team Members Only” or marked “Private”
- Changing Rooms
- Cashier cage windows
- PWBC business offices
These areas are off-limits to AV Recording and Wearable Technology (WT). No AV Recordings may be made in these areas. In addition, Wearable Technology devices may not be worn in these areas, even if not in use. - Gaming Floor. AV recordings are permitted on the gaming floor in specific, marked, areas, subject to the terms and conditions of an AV Recording License (described below) and any posted supplemental terms and conditions.
- Personal Recreational AV Recordings. Patrons may make AV Recordings, for personal non-commercial (recreational) use. These “Personal Recreational Recordings” must be intended for personal recreational use, and the subjects recorded must know the patron making the recording and consent to being recorded. Personal Recreational Recordings (i) may not include any Parkwest team members; (ii) may not include any gaming activity; (iii) may not be shared on any website or social media platform page for commercial purposes; and (iv) may not be used in any other manner for a commercial purpose.
- Licenses. Generally, the Casino will consider applications for two types of licenses under this Policy.
- Influencer [Social Media] License. This License is called a Location User Agreement for an individual to record their own play, in designated areas.
- Promotional use and personal use only.
- Influencer may use recordings on their own website or social media and no other commercial use of recordings is permitted.
- Recording may not be sold or used as commercial/stock footage.
- Influencer may not alter the images, video or audio to portray any Parkwest team member, business partner, or patron in an objectionable, unfavorable manner.
- WT – Influencer must agree NOT to wear any WT in other areas of the Casino.
- Disclosure – Influencer must not be employed by nor working in concert with or for the benefit of any other cardroom or tribal casino.
- Non-disparagement – Influencer must not use recordings to disparage or defame Parkwest or other individuals.
- Professional/Commercial License. This License may be granted to production companies or others engaged in recording for commercial purposes, such as advertisements, motion pictures, or television. The scope of these Location Use Agreements will be negotiated on an individual basis.
- Right to Use RT is Subject to Revocation. The Casino Management reserves the right to stop any patron from using AV Technology or wearing any WT at any time, in its sole discretion. Patrons who fail to comply with Management direction may be required to leave the Casino premises and future access may be restricted.
